Welcome to EZZYFOOD (“EZZYFOOD”, “we”, “our”, or “us”), a food ordering and restaurant marketplace powered by ezzy.ph and owned and operated by EZZYTech IT Solutions.

These Terms of Use (“Terms”) govern your access to and use of EZZYFOOD, including our website, mobile applications, and all services, products, and features offered through the Platform.

By accessing or using EZZYFOOD, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. About EZZYFOOD

Our Platform

EZZYFOOD is a technology marketplace that connects customers with independent restaurants, food merchants, cloud kitchens, caterers, and delivery partners.

Services available through the Platform may include:

  • Food ordering
  • Restaurant reservations
  • Pickup orders
  • Food delivery
  • Catering services
  • Beverage orders
  • Meal subscriptions
  • Grocery or specialty food orders (where available)
  • Promotions and discounts
  • Other food-related services available through the Platform

EZZYFOOD serves solely as a technology platform facilitating restaurant discovery, ordering, communication, payments, and delivery coordination between customers and independent providers. Unless expressly stated otherwise, EZZYTech IT Solutions does not own, prepare, cook, package, deliver, or supervise the food or services offered through the Platform.

2. Eligibility

User Requirements

To use EZZYFOOD, you must:

  • Be at least eighteen (18) years old or the age of majority under applicable law.
  • Have the legal capacity to enter into legally binding agreements.
  • Provide accurate, complete, and current account information.
  • Comply with these Terms and all applicable laws.

Parents or legal guardians are responsible for minors using their accounts where permitted by law.

3. User Accounts

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities conducted under your account.
  • Keeping your account information accurate and up to date.
  • Promptly notifying EZZYFOOD of any unauthorized access or suspected security breaches.

EZZYFOOD reserves the right to suspend or terminate accounts that violate these Terms.

4. Marketplace Services

Ordering Services

EZZYFOOD enables users to:

  • Browse restaurants and food merchants.
  • Compare menus and prices.
  • Place food orders.
  • Schedule future orders.
  • Choose pickup or delivery options.
  • Process payments where supported.
  • Track orders where available.
  • Submit reviews and ratings.

Service availability may vary depending on location, restaurant participation, operating hours, delivery coverage, and other factors.

5. User Responsibilities

Responsible Use

Users agree to:

  • Provide accurate delivery and contact information.
  • Pay applicable order and delivery fees.
  • Be available to receive deliveries.
  • Treat restaurant staff and delivery partners respectfully.
  • Comply with applicable laws.
  • Use the Platform lawfully and responsibly.

Customers are responsible for reviewing menu items, pricing, allergens, ingredients, estimated delivery times, cancellation policies, and restaurant information before confirming an order.

6. Independent Merchant Responsibilities

Merchant Obligations

Independent restaurants, food merchants, cloud kitchens, caterers, and delivery partners are solely responsible for:

  • Food preparation.
  • Food quality and freshness.
  • Ingredients and allergen information.
  • Food safety and hygiene.
  • Pricing.
  • Delivery services where applicable.
  • Customer service.
  • Required permits and licenses.
  • Compliance with applicable food safety and health regulations.

Merchants must ensure that all information published on EZZYFOOD remains accurate, complete, and current.

Providers acknowledge that they operate as independent businesses and are not employees, agents, or representatives of EZZYTech IT Solutions.

7. Orders and Payments

Payment Processing

Payments may be processed through authorized third-party payment providers.

Where applicable, EZZYFOOD may temporarily hold payments in accordance with the applicable Refund & Cancellation Policy before releasing funds to the independent merchant.

Where applicable, the Platform Service Fee and any authorized deductions will be applied before the remaining balance is released to the merchant.

Order pricing, delivery fees, service charges, cancellation policies, and estimated preparation times may vary depending on the merchant.

8. Platform Service Fees

Partner Fees

EZZYFOOD charges a Platform Service Fee of 11% on every completed transaction processed through the Platform.

The Platform Service Fee is automatically deducted before the remaining balance is remitted to the Partner.

The current Platform Service Fee includes payment processing costs and supports:

  • Platform maintenance
  • Secure payment processing
  • Customer support
  • Security and fraud prevention
  • Marketing initiatives
  • Technology infrastructure
  • Continuous platform improvements

Partners remain responsible for their own applicable taxes, permits, licenses, and government obligations.

EZZYFOOD reserves the right to revise its Platform Service Fee from time to time. Any changes will be communicated before becoming effective.

9. Reviews and Ratings

Community Reviews

Users may submit reviews based on genuine ordering experiences.

Users must not:

  • Publish false or misleading reviews.
  • Manipulate ratings.
  • Harass merchants, delivery partners, or customers.
  • Post defamatory or offensive content.

EZZYFOOD reserves the right to remove reviews that violate these Terms.

10. Food Safety and Allergies

Customer Responsibility

Customers are responsible for reviewing available allergen and ingredient information before placing an order.

If you have food allergies, dietary restrictions, or medical conditions, you should contact the restaurant or merchant directly before confirming your order.

While merchants are encouraged to provide accurate ingredient information, EZZYFOOD cannot guarantee that meals are free from allergens or cross-contamination.

11. Marketplace Disclaimer

Independent Merchants

EZZYFOOD serves solely as a technology marketplace connecting customers with independent restaurants, food merchants, caterers, cloud kitchens, and delivery partners.

Unless expressly stated otherwise, EZZYTech IT Solutions does not own, prepare, cook, package, deliver, supervise, or control the independent providers listed on the Platform.

Independent providers are solely responsible for:

  • Food preparation.
  • Food quality and safety.
  • Delivery services.
  • Pricing.
  • Customer service.
  • Compliance with food safety laws.
  • Required permits and licenses.

The Platform Service Fee charged by EZZYFOOD is solely for operating and improving the Platform and does not constitute payment for food or delivery services provided by EZZYTech IT Solutions.

12. Intellectual Property

Platform Ownership

All trademarks, logos, software, graphics, website content, text, images, videos, databases, and other intellectual property associated with EZZYFOOD are owned by EZZYTech IT Solutions or their respective owners.

Users may not copy, reproduce, modify, distribute, reverse engineer, scrape, or commercially exploit any part of the Platform without prior written permission.

13. Prohibited Activities

Platform Misuse

Users must not:

  • Violate applicable laws.
  • Commit fraud or identity theft.
  • Create fake accounts.
  • Use unauthorized payment methods.
  • Upload malicious software.
  • Attempt unauthorized access.
  • Interfere with Platform operations.
  • Circumvent Platform Service Fees.
  • Manipulate orders, payments, or reviews.
  • Harass merchants, delivery partners, or customers.

Violations may result in suspension or permanent termination of accounts.

14. Limitation of Liability

Liability

To the fullest extent permitted by law, EZZYTech IT Solutions shall not be liable for:

  • Food quality or freshness.
  • Allergic reactions.
  • Preparation or delivery delays.
  • Incorrect or incomplete orders.
  • Merchant or delivery partner actions or omissions.
  • Customer-provider disputes.
  • Technical interruptions.
  • Payment disputes beyond our reasonable control.
  • Any indirect, incidental, consequential, or special damages arising from the use of the Platform.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

15. Refunds and Cancellations

Refund Policy

Refunds and cancellations are governed by the applicable Refund & Cancellation Policy.

Independent restaurants, merchants, and delivery partners may establish their own cancellation, refund, replacement, and delivery policies where permitted by law.

Customers should review these policies before confirming an order.

17. Third-Party Services

External Services

EZZYFOOD may integrate third-party services including:

These services operate under their own terms and privacy policies.

18. Suspension and Termination

Account Suspension

EZZYFOOD may suspend or terminate accounts that:

  • Commit fraud.
  • Compromise Platform security.
  • Harm other users or providers.
  • Damage the reputation of EZZYFOOD or EZZYTech IT Solutions.

19. Governing Law

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the appropriate courts of the Republic of the Philippines.

We may update these Terms from time to time to reflect changes in our services, technology, legal requirements, or business operations.

Updated Terms become effective upon publication on EZZYFOOD.

Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
